Internal Compliance Programme-ICP

An amendment to the War Materiel Ordinance (WMO, SR 514.511)
came into force on 1 November 2021. Article 12a para. 2 WMO has been newly added.

Legal entities, i.e. joint-stock companies, limited partnerships
and limited liability companies (LLCs), must provide evidence of a reliable
internal control system (known as an internal compliance programme or ICP) in order to obtain a licence under legislation on war materiel.

A Proof of ICP form must be completed for each application to
open an Elic account and will automatically appear in the registration
signature form.

This proof has been required since 2016 for licences under goods
control legislation. The content of Article 12a para. 2 WMO corresponds to Art. 5 para. 2 of the Goods Control Ordinance (SR 946.202.1). With effect from 1 November 2021, Elic applications concerning industrial products (goods control legislation) no longer need to upload ICP proof with each individual transaction.

All legal entities that already have an Elic account must use the form supplied (Proof of ICP) to confirm to us in writing that they have an
up-to-date ICP. This form must be completed and signed by the company's
authorised signatories and sent to info.elic@seco.admin.ch before the next Elic application or by 31 December 2021 [FAB1] at the latest.

We will file the form in Elic.
