Access to documents under the Freedom of Information Act

The Freedom of Information Act gives everyone the right to access official documents without having to give reasons for their request. However, access may be restricted where overriding public or private interests apply.

Access to official documents

Under the Freedom of Information Act, anyone can request access to official documents without having to demonstrate a particular interest. They simply have to submit a request to SECO. However, the right of access is not absolute and may be restricted or refused where overriding public or private interests prevail.

Access requests are normally processed free of charge. However, a fee may be applied if processing takes more than eight hours.

If the competent authority refuses or restricts access, applicants may ask the Federal Data Protection and Information Commissioner (FDPIC) to mediate. If mediation fails to produce an agreed solution, the FDPIC issues a written recommendation. The competent authority may then issue a decision, which can be appealed.
