Pillar III: Access to remedy

Pillar III of the UNGPs establishes a core obligation: to ensure that victims of business-related human rights abuses have effective access to remedy.

The law

The National Action Plan translates Switzerland's Pillar III commitments into a number of targeted measures.

Inventory of barriers to remedy

The Confederation publishes an analysis of existing judicial and non-judicial mechanisms and the barriers to accessing them, provides information for different audiences, and sets out recommendations for addressing those barriers where appropriate.

Private sector grievance mechanisms

The Confederation explains how non-governmental grievance mechanisms work, supports businesses in developing guidance on access to remedy, and raises their profile in collaboration with various multi-stakeholder initiatives, including the Centre for Sport & Human Rights.

Human rights defenders

The Confederation is establishing a standardised procedure for monitoring communications and complaints from human rights defenders. The FDFA also supports the Geneva center for Business and Human rights project to build links between businesses and human rights defenders, in partnership with organisations such as the International Service for Human Rights (ISHR).
