The provisions of the Law on Product Safety apply on a subsidiary basis, provided there are no other specific federal legal provisions with the same objective (art. 1 par. 3 of the Law on Product Safety).

Anyone placing a product on the Swiss market is liable for its conformity with the applicable technical regulations, even if the conformity assessment was carried out by a third party.
Any product placed on the Swiss market can be subject to market surveillance by the responsible authorities.
