Reports on specific cases

The NCP publishes a report setting out whether the submission falls within the scope of the Guidelines and whether it will take action in the case in question. If it offers mediation and, where appropriate, follows up on the agreement reached by the parties or the recommendations issued by the NCP, it also publishes these findings in reports.

In a preliminary review, the NCP decides, on the basis of information provided by both parties, whether the specific case falls within the scope of the Guidelines. The NCP publishes a report on its decision to accept or reject the case and sets out the reasons for its decision. If it offers mediation and the parties reach a joint solution to the dispute, the NCP publishes the outcome in a report. If no agreement is reached, the NCP also makes this known. In the report, the NCP may also make recommendations on the implementation of the OECD Guidelines. If the NCP takes specific follow-up measures regarding the agreement reached by the parties or the recommendations it has issued, it will also publish a report on this. At no stage of the procedure does the NCP determine whether a company has acted in accordance with the OECD Guidelines or not.
